1. Acceptance of Terms
By accessing or using Miki's AI-powered sales assessment platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Miki provides an AI-powered platform for assessing sales candidates through simulated customer interactions. Our Service includes persona creation, scenario building, candidate assessment, and AI-generated scoring and analysis.
3. Account Registration
You must register for an account to use the Service. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Subscription and Payment
Paid subscriptions are billed monthly in advance. All fees are non-refundable except as required by law or as explicitly stated in these terms.
We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Discriminate against candidates based on protected characteristics
- Attempt to reverse-engineer or extract our AI models
- Share account credentials with unauthorized users
- Use the Service to develop competing products
- Circumvent any security or access controls
6. Candidate Data and Consent
You are responsible for obtaining appropriate consent from candidates before using our Service to assess them. You must inform candidates that they are interacting with an AI system and that their responses will be analyzed and stored.
7. AI-Generated Content
Our Service uses AI to generate personas, conduct conversations, and score candidates. AI-generated assessments are tools to assist your hiring decisions, not definitive judgments. You retain responsibility for all hiring decisions.
8. Intellectual Property and Service Improvement
You retain ownership of content you create (personas, scenarios, job postings). We retain ownership of the Service, including our AI models, algorithms, and platform code. You grant us a license to use your content as necessary to provide the Service.
Miki uses assessment data to deliver the product, maintain security, and improve the service as described in our agreements and privacy documentation. By default, customer workspace content is not used to train shared or public AI models.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIKI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
10. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. We will retain your data for 30 days to allow export, after which it will be deleted unless legally required to retain it.
11. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
